Kermani traces the history of mankind from the origins of society and language to the present, and un-mutes the silence that resulted from the moment man began to write his history instead of listening to history's story.

One of the important areas where the development of Islamic calligraphy can be observed is the tombstone inscriptions. As a reflection of the evolution of calligraphy in the 18th and 19th centuries of the Ottoman Empire, tombstone inscriptions also began to contain high artistic value. Especially the epitaphs of the tombstones belonging to the noble families, state officials and the people of the palace, combined with the fine workmanship, became works of art. These examples are important records for art history (...) as they mostly contain signatures and dates. Gravestones, which are important in many aspects, especially art, literature and history, are mostly open to the public and therefore to destruction. This situation makes it necessary and meaningful to evaluate historical gravestones in a multi-faceted way and to reveal their value. Therefore, serious research on gravestones is extremely valuable. This article is about the gravestones signed by calligraphers of the cemetery belonging to the Yahya Efendi Complex in Istanbul-Beşiktaş. The study includes the analysis of the data collected before the 2009-2013 restoration, considering the current situation of the cemetery. The cemetery is home to tombstones with high artistic value due to the importance of the buried people. There are over two thousand tombstones in the cemetery, which has an important place within the social complex. Some of these stones attract attention with their decorations and stone workmanship, as well as their inscriptions, which are rare examples of calligraphy art. Among these inscriptions, seventy-nine samples signed by calligraphers were found and these samples were examined within the scope of the article. It is possible to see the prominent artists of the last period among the calligraphers whose works are found in the cemetery. Yahya Efendi Cemetery is home to the signed epitaphs of twenty-seven different calligraphers, mainly Aziz Efendi, Sâmi Efendi, Şefik Efendi, Şevki Efendi, Hulusi Efendi, İzzet Efendi, Nuri Korman, Arif Efendi and Halim Özyazıcı. How can suffering and injustice be reconciled with the idea that God is good, that he loves humans and is merciful to them? Job's question runs through the history of the three monotheistic religions. This uneasy intellectual of the Republic tries to find peace with a reasonable synthesis, such as changing to continue and continuing to change. The soul of time and space pervades every line that comes out of Ahmet Hamdi Tanpınar's pen. In his poem Time in Bursa (Bursa’da Zaman), which deals (...) with Ottoman life manifestations, is written to Bursa, known for its profound influence on the Tanpınar, where the synthesis of culture is seen on each corner. To comprehend Tanpınar’s poetry, it is necessary to think about time, space, memory, history, dream and imagination. These concepts take place in the lines of the Tanpınar as a call to the forgotten social identity. It is certain that imaginative memory has a collective dimension. The cultural memory that transcends individual life and becomes historical re-establishes the past by way of recollection. At this point, memory holds on to time and space against forgetting. For this reason, Ahmet Hamdi Tanpınar looks at time and space with another perspective. The poet, aware of the interaction of time and space with memory, attributes a symbolic meaning to these concepts. In this study, time and space perception of Ahmet Hamdi Tanpınar will be sketched out from the poem of Time in Bursa and the world of feeling and thought that shapes his works will be tried to be determined. This study tries to show the relation between technê and the ethical sphere in the Ancient Greek through mythology and the philosophical literature. Both in mythology and in the philosophical framework the benefits of technê and the power provided by technê for humanity are emphasized. And technê is considered as competence increases the control of human beings in practical areas. However, the ambiguous character of the human experience related to technê and the morally problematic character of this field is also (...) pointed out in the literature. Because, if not controlled, technê has a potential to turn easily against humanity and to produce things that would harm human beings. At this point, ethical values have a crucial role in the control of technê. Technê as a type of knowledge which gives how to do things and how to control the environment but does not give why something is to be done and cannot give an ultimate goal should be subject to higher spheres in the philosophical framework. Being a stranger has become a global definition due to the migrations caused by the wars and unemployment in the Middle East and the perceptions of Islamophobia and Islamic terrorism prevailing in the West. In Alfred Schutz’s essay The Stranger, he deals with this issue in terms of orientation and adaptation problems and gives information about this concept by making use of different examples. Mahir Guven also rehandles the concept of the stranger in his novel Older Brother (Grand Frère) by (...) building on the story of an immigrant family. Older Brother is a contemporary and political novel. It tells of two brothers in their thirties who grew up in a multicultural family (Turkish mother, Kurdish father, and two brothers; one is a half‑Syrian taxi driver, and the other is a half‑French surgical nurse) in the suburbs of Paris. The novel interrogates concepts such as nationality, belonging, family ties, culture, identity, immigration, and foreignness through the eyes of the characters. Starting from the problem of being a stranger, which has become a big problem with the effect of increasing immigration movements, we will try to examine the novel Older Brother from Alfred Schutz’s point of view approach to this matter. Dürziler, gerek itikadi açıdan gerekse de hukuki prensipleri bağlamında Osmanlı-Hanefi ideolojisi dışında kalan bir cemaatti. Bununla birlikte Dürzi liderler 19. Yüzyılın başlarına kadar devletin Cebel-i Lübnan’daki idari tem-silcileri olarak siyasi otoriteyi ellerinde tutmayı başardılar. Bunun yanı sıra geleneksel hukuklarını da koruyan Dürziler, Osmanlı Devleti’nin sosyal yapısını oluşturan Millet Sistemi içinde farklı bir pozisyonda kimlik edindiler. Tanzimat reformlarının Cebel-i Lübnan’da uygulanmaya başlaması ise Dürzilerin kimlik tanımlarında siyasi paradigmaların dışına çıkmalarına sebep olmuş, Osmanlı kimliğini İslami terminolojiyle tamamlamak adına hareket eden cemaat, hukuki (...) statülerini bir meşruiyet aracı olarak kullanmaya başlamış ve devletin değişen reformist duruşu karşısında farklı bir hukuki yer edinmeye çalışmışlardı. Despite recent noticeable changes in women’s educational opportunities in developing countries such as Iran, there is still much controversy surrounding the common assumption that a direct relationship exists between women’s empowerment and formal literacy. According to the social semiotic method, the present research explores the hidden side of the female educational experience and its relationship with empowerment. In the current study, we conducted 39 interviews and analyzed the collected data using Van Leeuwen’s semiotic approach. The results are based on the (...) analysis of three semiotic sources, all of which are ubiquitous in the daily life of Iranian students: uniforms, queues, and homework. The findings indicate that the emphasis on the ideological aspects of educational experiences, in the form of a ritualistic approach by the educational system’s agents, causes a gradual semantic break between students and educational goals. Such an emphasis also instills an ambiguous and contradictory understanding in the student’s mind, of which the final result is the alienation and internalization of passive patterns of social action. A long and vehement dispute once raged about the reality of universals. Are they only mental creations, forged by the human brain, without any reality outside them, or have they some independent existence apart from their mental reality? Anyhow, there was an apparent contradiction between die universal character of our ideas and the individual character of concrete things. (...) The Scholastics solved this problem by drawing clear distinctions. An idea is an abstraction; as soon as it becomes applicable to a number of objects or things in the same sense, it is a universal idea. The "direct universal" (universale directum seu metaphysicum) as such has no existence apart from our minds, because an existing thing is always bound up with concrete, determining, individualizing notes, and it is these very circumstances or accidents which are ignored by the mind as it strips the thing of its individual characteristics. When the mind reflects on this "direct universal," i.e., on the abstract essence of the thing, it sees that this is to be found in many more things and that it is identical in all those things, and in this way the "reflex or logical universal" is formed (universale reflexum seu logicum). This same essence or quiddity is not really different from the thing itself, but the mind makes abstraction of all accidents, and this foundation makes it possible to apply this idea in die same sense to all other beings of the same kind, whether they are actually existing or not. In other words the universal as a universal has only reality in the mind but it has a foundation or a ground in the thing itself. Newman was not so well acquainted with Scholasticism that he knew and mastered the solution of the problem. As a matter of fact he approached it from quite another angle. Hence when scholastically trained minds read some of his statements on universals, they may feel shocked. They sound very curious, they seem incon418 DR. ZENO, O.F.M. CAP.419 sistent with each other, they apparenüy imply a negation of the objective reality of universals. This makes it necessary to compare the texts and to explain his meaning. a. Newman Inconsistent. We should never lose sight of the fact that Newman had no intention at all to enter the province of philosophy in the restricted sense of the word. "I am only contemplating the mind as it moves in fact, by whatever hidden mechanism,"1 that is what could be put as a heading to every page of the Grammar of Assent. And when he virtually deals with metaphysics, he wants us to consider his statements as hypotheses, or as propositions stated only by the way, and in this department he always wishes "to speak under correction." This explains how he could refer to the universale metaphy sicum and the universale directum in a very correct way without realizing he was teaching Scholastic doctrine. As far as I know, it is Professor Walgrave who has first drawn attention to this fact,2 when he dealt with Newman's alleged conceptualism. Newman states that "even one act of cruelty, ingratitude, generosity or justice reveals to us at once intensive the immutable distinction between those qualities and their contraries; that is, in that particular instance and pro bac vice."3 The same holds for the opposites: right and wrong, true and false, just and unjust, beautiful and deformed.4 In one experience, therefore, he sees a thing as an immutable, absolute quiddity, which objectively and in the same sense belongs to all possible things of the same kind, although the mind does not yet explicidy confirm this universal applicability. The contemplated quality remains limited to the particular case; but in its absoluteness it is stripped of all individual, changeable and concrete characteristics. This is the metaphysical universal of the Scholastics. But Newman also mentions the logical universal when he says: "As we form our notion of whiteness from the actual sight of snow, a lily or a cloud, so, after experiencing the sentiment of approbation which arises in us on the sight of certain... This paper presents an implementation of two radically different control schemes for a state-coupled two-tank liquid-level system. This is due to the purpose of transferring theoretical studies to industrial systems. The proposed schemes to be introduced and compared are the nonsingular terminal sliding mode control and the backstepping control. The performances of the developed methods are experimentally tested on a particular class of second-order nonlinear systems. The main purpose of the considered control schemes is to achieve a tracking trajectory for (...) a coupled-tank system. It is proved that the designed robust controllers guarantee the stability of the corresponding closed loop systems. The obtained results are verified with the same setup test to ensure a suitable basis for their comparison. During the experiments, we resorted to adding an integrator to the backstepping control so that we improve the results, leading to the appearance of the integrator backstepping control. To focus on the adequacy and applicability of the suggested control layout, theoretical comparisons as well as experimental results are afforded and debated. (shrink)

This will make us better acquainted with the nature (...) of the illative sense. I. THE SENSES 1. The External Senses and their Objects. We had already arrived at the conclusion that Newman rejects the mere subjectivity of our knowledge. When he writes about this matter he explicitly deals with sensation or sensuous cognition. Although he takes exception to the word "immediate perception," 1 we may nevertheless call him an adherent of direct or immediate realism according to Scholastic terminology, because he emphatically excludes the intervention of a reasoning process from sense perception and uses the term "mediate perception" only to express the instrumentality of experience. In this meaning our perception of external objects is mediate or indirect indeed.2 The fact is that as early as 1839 he wrote in his University Sermons: "Of the material we have direct knowledge through the senses"3 and in 1843: "The senses are direct, immediate, and ordinary informants, and act spontaneously without any will or effort on our part."4 On the importance of sense perception for our mental activities he writes in a series of hitherto unpublished notes, entitled Elements of Thought:6 "I grant or I assume that the soul would not think without some external stimulus; that if it were cut off from all communication from the external world, it would pass this life in a sort of torpor... Various domains of life widely recognise the concept of human rights. Regardless of one's spiritual beliefs or background, individuals possess an inherent understanding of their fundamental rights. This knowledge of human rights originates from Allah, who has communicated it through various messengers, including the esteemed Prophet Muhammad ﷺ. This study focuses on examining the religious perspective on basic human rights in order to establish a comprehensive understanding of these rights. There are two revelations: This study employs a linguistic descriptive analysis (...) approach to evaluate the Holy Quran and the guidance of the Prophet. The study primarily focuses on conducting a content analysis and descriptive analysis of case studies and literary insights found in the Holy Quran and the Prophet's ﷺ guidance. The goal is to extract as much content as possible about human rights. The study has identified four major themes defined by the Holy Quran and the Prophet's ﷺ guidance. The study has improved our understanding of key human rights concepts and suggests that future scholars concentrate on assessing other fundamental rights that the two revelations under investigation have illuminated. This paper investigates the structure of networked publics and their sharing practices in Persian Twitter during a period surrounding Iran’s 2017 presidential election. Building on networked gatekeeping and framing theories, we used a mixed methodological approach to analyze a dataset of 2,596,284 Persian tweets. Results revealed that Twitter provided a space for Iranians to discuss public topics. However, this space is not necessarily used by voiceless and marginalized groups; and the uses are not limited to discussing controversial issues. The growing (...) body of conservative crowdsourced elites emerged to defend the regime’s ideology. Moreover, the dominant networked frames were shaped around normal and routine subjects in an election time. Thus, Twitter was not a platform for only seeking liberal demands. It was to some extent used to serve the regime’s political interests. Furthermore, while many ordinary users rose to prominence, mainstream media continued to act as powerful players. This study contributes to the existing literature into networked practices, digital democracy, and citizen journalism; particularly in restrictive contexts. (shrink)

In today’s marketing conditions, it becomes really vital for companies to establish an appropriate relationship with suppliers and salesperson based on ethical values in order to survive. Besides, ensuring an effective relationship between the parties would contribute to increase buyer satisfaction along with economic and social satisfaction. In this study, the direct effects of suppliers’ and salespersons’ unethical behaviors on buyer satisfaction, and the moderator effect of communication between buyer–supplier relationships are examined. The results of the study have revealed that (...) unethical behaviors of suppliers and salesperson affect buyer satisfaction negatively and the communication variable has moderately affected. Der Beitrag plädiert für eine stetige Dokumentation von Ethikberatungen (interne Dokumentation). Auf diesen Grundlagen können unterschiedliche Berichte über Ethikberatungen mit unterschiedlichen Inhalten und unterschiedlichen Adressaten entstehen. Es wird zwischen einem Ergebnis- und einem Verlaufsbericht unterschieden. Diese werden von summarischen Zeitraumberichten oder einem Berichtssystem Ethikberatung abgegrenzt. Ergebnisberichte mit einer Darlegung des Beratungsergebnisses und den wichtigsten ethischen Argumenten werden häufig in Krankenunterlagen eingeordnet. Verlaufsberichte dienen in der Regel eher (...) Ausbildungs- und Qualitätssicherungszwecken.Dokumentationen in diesem weiten Sinn können zu einer Professionalisierung der Ethikberatung beitragen. Dabei ist es aber von zentraler Bedeutung, sich die Zielsetzung der jeweiligen Form von Dokumentation zu vergegenwärtigen und ehrlich und aufrichtig nach Schwächen und Entwicklungspotenzialen der Beratung zu ethischen Fragen im klinischen Alltag zu suchen. _The Contradictions of Modern Moral Philosophy_ is a highly original and radical critique of contemporary moral theory. Paul Johnston demonstrates that much recent moral philosophy is confused about the fundamental issue of whether there are correct moral judgements. He shows that the standard modern approaches to ethics cannot justify - or even make much sense of - traditional moral beliefs. Applied rigorously, these approaches suggest that we should reject ethics as a set of outdated and misguided claims. Rather than facing (...) up to this conclusion, most recent moral philosophy consists of attempts to find some ways of preserving moral beliefs. This places a contradiction at the heart of moral philosophy. As a resilt it is often impossible to tell whether a contemporary philosopher ultimately rejects or endorses the idea of objective right and wrong. On the basis of a Wittgenstein approach Paul Johnston puts forward an alternative account of ethics that avoids this contradiction and recognises that the central issues of ethics cannot be resolved by conceptual analysis. He then uses this account to highlight the contradictions of important contemporary moral theorists such as Bernard Williams, Alasdair MacIntyre, Thomas Nagel and Charles Taylor. (shrink)

Historically, scientists in training have learned the rules of ethical conduct by the example of their advisors and other senior scientists and by practice. This paper is intended to serve as a guide for the beginning scientist to some fundamental principles of scientific research ethics. The paper focuses less on issues of outright dishonesty or fraud, and more on the positive aspects of ethical scientific behavior; in other words, what a scientist should do to maintain a high level of ethical (...) conduct in research.There are a number of fairly specific rules, guidelines, or commonly accepted operating principles that have evolved for the ethical conduct of science. In order to discuss this code of ethics, this paper is divided into sections dealing with specific areas of scientific ethics. These areas are: data collection and storage, ownership of data, confidentiality, communication, authorship, collaboration, the peer review system, and rules of dealing with ethical complaints. Illustrative case histories are presented to provide examples of the type of ethical dispute or problem being discussed. If scientific trainees learn the accepted rules of behavior that govern the conduct of science, ethical problems that arise out of ignorance, misunderstanding, or poor communication can be avoided. Resnik’s argument relies upon an undefended and unjustified overvaluation of liberty. First, he overlooks some important arguments in favour of restrictions to liberty, and his consideration of the two he does review is unfair; second his account grossly overestimates the autonomy of our food choices; and lastly his mechanism for balancing liberty against other concerns involves an illicit double counting of the weight of individual liberty.

We propose that institutions consider establishing a position of “Ombudsman for Research Practice”. This person would assume several roles: as asounding board to those needing confidential consultation about research issues — basic, applied or clinical; as afacilitator for those wishing to pursue a formal grievance process; and as aneducator to distribute guidelines and standards, to raise the consciousness regarding sloppy or irregular practices in order to prevent misconduct and to promote the responsible conduct of research. Wie muss ein ethischer Beratungsdienst strukturiert sein, damit er in moralischen Konfliktsituationen im klinischen Alltag angefragt wird und die Ratsuchenden ergebnisorientiert unterstützen kann? Nach welchen Kriterien lassen sich die Beratungsgespräche auswerten und bewerten? Zur Beantwortung dieser Fragen werden theoretisch fundierte Konzepte ethischer Fallbesprechung aus Nimwegen, Leuven und Basel herangezogen; dies geschieht vor dem Hintergrund der Erfahrungen mit der über zehnjährigen Entwicklung der ethischen Arbeit im Ev. Krankenhaus Bielefeld (EvKB). Als Resultat stellen wir einen strukturierten, multidisziplinären Ansatz vor, mit dem in (...) den Beratungsgesprächen die ethischen Dimensionen unterschiedlicher Vorstellungen herausgearbeitet und möglichst einvernehmlichen Lösungen zugeführt werden. Am Beispiel des EvKB lässt sich zeigen, dass der ethische Beratungsdienst auch in Zeiten knapper Ressourcen implementiert und praktiziert werden kann und eine Gesprächskultur schafft, die zu neuen Zielvariablen führt; hier spielen der Perspektivenwechsel und die Prozessgerechtigkeit eine zentrale Rolle und liefern zugleich Ansatzpunkte für unsere eigene Evaluationsstrategie. Zum aktuellen Stand der Evaluation klinischer Ethikberatung wird die internationale Literatur kritisch gewürdigt. Erste konzeptionelle Ansätze und Ergebnisse einer eigenen Evaluationsstrategie werden vorgestellt. Durch die Offenlegung hoffen wir, die Auseinandersetzung mit diesen Themen zu intensivieren. Der Beitrag diskutiert Möglichkeiten emotionalen Lernens in einzelfallbezogenen Lernarrangements wie etwa klinische Ethikberatungen und Workshops, die mit Einzelfällen arbeiten. Es wird ein didaktisches Rahmenkonzept entwickelt, das vor allem auf die Ermöglichung emotionalen Lernens abzielt. Dabei werden entsprechende Lernziele formuliert, emotionale Themen in diesen Lernarrangements benannt und Methoden dargestellt, wie Erwachsenenbildner diese emotionalen Themen so bearbeiten können, dass ein emotionales Lernen ermöglicht wird. Dabei wird auch ein konzeptueller Rahmen für diese Lernarrangements benannt, der von einem deliberativen Ethikverständnis ausgeht. Emotionales Lernen als (...) Förderung der Sozial- und Selbstkompetenz wird dabei als eine Schlüsselqualifikation verstanden, die gegen die Fach- und Methodenkompetenz abgegrenzt wird. (shrink)

In diesem Artikel geht es um die Beziehungen zwischen der von Jürgen Habermas entwickelten Diskursethik und den Studierendenseminaren, die der Ulmer Arbeitskreis „Ethik in der Medizin“ veranstaltet. Zunächst erfolgt eine Darstellung der Kernaussagen der philosophischen Diskursethik. Sie liefert eine formale Argumentationsprozedur, mit der es möglich ist, die Legitimität strittig gewordener Normen im Diskurs zu prüfen. Anschließend wird das in Ulm von Baitsch und Sponholz entwickelte Modell der Seminare „Ethische Entscheidungskonflikte im ärztlichen Alltag“ vorgestellt. Da sich die Ulmer Seminare unter anderem (...) auf die Diskursethik als theoretischen Hintergrund berufen, werden die Gemeinsamkeiten und Unterschiede beider Konzepte untersucht. Der Hauptunterschied ist der zwischen einem Begründungs- und einem Anwendungsdiskurs. Gemeinsam sind den Ansätzen die grundsätzlich kognitivistische Einstellung und die „Spielregeln“ des Diskurses. Eines der medizinischen Felder, in dem die ethische Diskussion um die „wunscherfüllende Medizin“ am intensivsten geführt wird, ist die Reproduktionsmedizin, die die Erfüllung des „Kinderwunsches“ verspricht. Strittig ist besonders, ob Sterilität als Krankheit definiert wird, die eine medizinische Intervention rechtfertigt, ob sich aus der Sterilität oder Infertilität lediglich ein Abwehr- oder auch ein positives Anspruchsrecht auf medizinische Ressourcen ergibt, ob legitime Fortpflanzungsmedizin Grenzen hat. Nach einer Übersicht über Eckpunkte der nationalen und internationalen Debatte beschreiben wir im zweiten Teil Ansichten zum (...) Status ungewollter Kinderlosigkeit, zum Recht auf Fortpflanzungsmedizin und zur möglichen Legitimität ihrer Begrenzung anhand der Ergebnisse unserer vom Bundesministerium für Bildung und Forschung (BMBF) geförderten Studien. Während der letzten fünf Jahre haben wir u. a. Paare mit und ohne Sterilitätsproblematik sowie verschiedene Expertengruppen qualitativ und standardisiert befragt. Die stark divergierenden Auffassungen konfrontieren wir im dritten Abschnitt mit internationalen Standards, zum anderen mit dem „Capability-Ansatz“ und dem freiheitsfunktionalen Liberalismus von Sen und Pauer-Studer. Dies ergibt, dass die Bereitstellung verschiedener Möglichkeiten der In-vitro-Fertilisations-(IVF-)Behandlung nicht lediglich einen Wunsch auf Elternschaft erfüllt sondern als die gesollte Erfüllung eines normativen Bedürfnissanspruchs begriffen werden muss. Die Frage nach dem Ursprung des Bösen spielt nicht nur für die Theodizee (" Warum lässt Gott das zu?"), sondern auch für das Selbstverständnis des Menschen und die Beweggründe zu (un-)moralischem Handeln eine entscheidende Rolle. Was aber ist genau unter dem Bösen zu verstehen? Wo liegt sein Ursprung? Mit seinen drei Beiträgen, des Theologen und Religionsphilosophen Ingolf U. Dalferth, des früheren Dogmatik-Professors und jetzigen Bischofs Karl Kardinal Lehmann und des Orientalisten und Schriftstellers Navid Kermani, bietet dieser Band Antworten aus (...) der Sicht verschiedener Konfessionen und Religionen. Dabei geht es u.a. um die Unterscheidung zwischen vermeidbaren und unvermeidbaren Übeln, um die Freiheit des Menschen und seine Verantwortung für das Böse und um die Tradition der Gottesklage im Islam. Ein Leitmotiv der medizinethischen Auseinandersetzung mit der tiefen Hirnstimulation (THS) ist die Beschäftigung mit Fragen personaler Identität. Da es sich bei personaler Identität auch um ein Problem der theoretischen Philosophie handelt, wird in diesem Aufsatz nicht nur die praktische Frage nach der ethischen Legitimation der THS durch informierte Einwilligung gestellt und ein modifiziertes Legitimationskriterium für wesensändernde THS erarbeitet. Vielmehr wird zunächst versucht, das Problem, um das es in der Debatte um THS und personaler Identität geht, besser zu verstehen.

Zur patientenorientierten Behandlung bei nichteinwilligungsfähigen Patienten werden aktuell der Einbezug oder auch die Entscheidung durch ein Ethikkonsil oder klinisches Ethikkomitee (KEK) gefordert. Damit die Entscheidung des Entscheidungsträgers durch das KEK unterstützt werden kann, müssen Zuständigkeiten, Besetzung und Arbeitsweise des Gremiums klar umschrieben sein.

Die jüngste höchstrichterliche Rechtsprechung zur Selbstbestimmung der Patienten und zur Normierung medizinischer Handlungen am Lebensende hat eine intensive Debatte ausgelöst. Das Urteil und die akademisch vorgetragene Kritik werden einer grundlegenden medizinethischen Analyse unterworfen. Sie betrifft die objektive Eingrenzung der Zulässigkeit einer Behandlungsbegrenzung und die Subsumtion des Wachkomas als irreversibel tödliches Grundleiden, das ärztliche Ermessen bei der Indikationsstellung, die normative Einordnung einer Ernährungstherapie am Lebensende und die Verbindlichkeit von Patientenverfügungen. Die medizinethische Kritik offenbart eine unzureichende Wahrnehmung medizinischer und medizinethischer professioneller Dokumente (...) und den Rückgriff auf medizinethisch veraltete Konzeptionen der Sterbehilfe durch das Gericht. Die Folge ist eine fehlerhafte Subsumtion der Wachkomapatienten in die Kategorie irreversibel tödlicher Erkrankungen und eine inhaltliche Schwächung der Verbindlichkeit von Patientenverfügungen. Beides bedarf dringend der Korrektur. (shrink)
